HB 195 – Board of Nursing Technical Changes

Bill Summary

This bill makes technical changes to the NC Board of Nursing. The bill includes addressing procedural efficiencies and fee ceiling increases.

Board Compensation

The bill clarifies that the per diem compensation for Board members shall not exceed $200 per member.

Mental Health Examination

The bill states that the Board is empowered to request a mental health exam by a licensed mental health professional. The results of the examination would be required to be presented to the Board.

Investigation

The bill gives NCBN the authority to subpoena records and documents concerning matters to be heard by the board. This must be done in accordance with laws regarding the patient/provider relationship, records, and documents.

Fees

The bill increases the licensure application from $75 to $100.

A two year renewal would increase from $100 to $200.

A reinstatement of a retired nurse would increase from $100 to $200.

Disciplinary Authority

The bill adds language to increase it’s disciplinary authority for excessive use of alcohol, drugs, and unprofessional conduct.

Appeal

The bill allows licensees to appeal a public disciplinary action made by the board within 30 days.
